Jakarta, (ANTARA News) - Coordinator of Presidential Staff Teten Masduki said that the deregulation of 233 items of legislation had not yet significantly overcome business constraints due to a number of matters.

"The government`s main focus currently is to launch deregulation on the legislation that hampers the implementation of ease of doing business, yet there are still four challenges being faced in the deregulation program," Masduki stated here on Wednesday.

The presidential staff coordinator made the statement in a national seminar on legal reforms entitled "Towards Effective and Efficient Regulation."

The first challenge is the many overlapping regulations, ranging from laws to regional provisions or bylaws. For this, Masduki stressed the importance of harmonization among institutions from the beginning of the drafting of the regulations.

"A ministry can be appointed as the central ministry regarding matters that are promulgated, so that other ministries can leave rules to the central ministry. Yet this is indeed not easy considering the presence of sectoral egos," Masduki remarked.

The second obstacle or challenge, according to Masduki, is the authority possessed by the ministers in issuing permits in their respective sectors. This results in quite a lot of overlapping regulations among ministries.

The third is that there were many regional regulations or bylaws (Perda) which were not in line with the regulations issued by the central government.

"Each region has its own plans, whereas economically, one district is said to be difficult or even impossible to be autonomous because the regional budget (APBD) is inadequate," Masduki explained.

The last challenge is the cancellation of regional regulations which, at this time, have become the authority of the regional government head.

"Based on the decision of the Constitutional Court Number 137 / PUU-XII / 2015, the home affairs minister cannot cancel regional regulations," Masduki asserted.

He added that one solution to help overcome excessive regulation is to establish a single authority body responsible for the functions of government in the field of legislation.
