Presidential Special Staff for the social sector Angkie Yudistia remarked here on Monday that President Jokowi spoke of a shift in the state paradigm for citizens with disabilities, from charity-based to human-rights based.
"From the side of the law and its derivative products, it is very clear that the paradigm of fulfilling human rights for citizens with disabilities is not just a rhetoric," she noted.
He explained that article by article stipulated in Law Number 8 of 2016 clearly and expressly highlights that disabled people have the same rights as their non-disabled counterparts based on the principle of non-discrimination.
Angkie expounded that currently, two governmental regulations were issued as implementing regulations for Law Number 8 of 2016. The two governmental regulations are Government Regulation Number 52 of 2019 on Social Welfare for Persons with Disabilities and Government Regulation Number 70 of 2019 on Planning, Implementing, and Evaluating Efforts, Respect, Protection, and Fulfillment of the Rights of Persons with Disabilities.
Government Regulation Number 70 of 2019 is equipped with a Master Plan for Persons with Disabilities, which is a master plan where national and regional development accommodates the rights of people with disabilities in a measurable, structured, and systematic way.
"Of the two government regulations, it clearly places people with disabilities as development subjects entitled to participate in the development planning, implementation, and evaluation process," he remarked.
In other words, disabled citizens are given the right and opportunity to participate fully as subjects of development and enjoy the results of development.
Development that accommodates rights and gives access to people with disabilities as equal subjects, both in the process and in enjoying the results of development, is called development of inclusion.
"In addition to the two regulations, six government regulations are currently being drafted.
"Of the six draft government regulations, it will guarantee the availability of buildings, public facilities and inclusive disaster management, and adequate accommodation for students with disabilities," she stated.
Furthermore, guaranteeing adequate accommodation for persons with disabilities in the judicial process; the existence of a disability service unit in the field of employment; comprehensive rehabilitation and habilitation for persons with disabilities; and the existence of concessions and incentives in the context of respecting, protecting, and fulfilling the rights of persons with disabilities.
"There is another draft presidential regulation on the establishment of the National Disability Commission (KND) as a regulation derived from Law Number 8 of 2016," she remarked.
With the presidential regulation, the National Disability Commission (KND) will become a strong and independent institution for the participation of persons with disabilities in monitoring and evaluating the rights of persons with disabilities in ministerial and institutional programs.
"In addition, providing recommendations for binding solutions to all forms of violations of the rights of persons with disabilities," he added.
