"I hope that law enforcement officials can continue to investigate this case, including the motives, and ensnare the perpetrator with severe punishment according to the law," the ministry's deputy for the special protection of children, Nahar, said in Jakarta on Thursday.
According to him, the case has roused deep concern because of the tragic fate of the child who died at the hands of her biological parent, who should have ideally provided her with the best love and care.
"I am very concerned and express my deepest condolences for the death of AK, who was still 9 years old, because she was stabbed by her own biological father, MQA (29). This incident is very tragic considering that children should receive love and good care from their parents," he added.
Nahar further said that MQA could be charged under Article 80 Paragraph (3) and Paragraph (4) jo. 76C, Law Number 35 of 2014 concerning Child Protection, which carries a maximum prison sentence of 15 years and a maximum fine of Rp3 billion, and an additional penalty of one-third because the perpetrator is the parent of the victim.
MQA could also be charged under Article 44 Paragraph (3) of Law Number 23 of 2004 concerning the Elimination of Domestic Violence, which carries a maximum prison sentence of 15 years and a fine of Rp45 million.
According to Nahar, charges against MQA could also be filed under Article 340 of the Criminal Code (for premeditated murder) and/or Article 338 of the Criminal Code related to the crime of murder, which invites the death penalty or imprisonment for life or for a specified period of up to 20 years.
