The commission said in the Development Discussion Series II streamed by the National Research and Innovation Agency (BRIN) on Tuesday, it has discovered a number of regional regulations that do not match the law at the central level, and are likely to lead to human rights violations.
"The problem also lies on the national level. There are still laws that are prone to human rights violations," Chief of Komnas HAM Atnike Sigiro said.
For instance, she informed, the National Commission on Violence against Women (Komnas Perempuan) has recorded a number of regional regulations that target minority groups and can lead to acts of discrimination as well as human rights violations.
At least 154 local regulations have been identified by Komnas Perempuan in the period from 2009 to 2015 that may lead to discrimination and human rights violation, she said.
Meanwhile, on the national level, Komnas HAM highlighted the Law on Electronic Information and Transaction (UU ITE), which can violate freedom of expression and opinion.
"This is a law that can be used to attack and criminalize other people with differing opinions," she explained.
The Minister of Religious Affairs and Minister of Home Affairs' Joint Regulation on the Establishment of Houses of Worship often causes conflict and discriminates against minorities in establishing a house of worship, she said.
To handle these issues, Komnas HAM has released the Norm and Regulation Standards (SNP), which cover national and international human rights law formulation, and a guide on how human rights should be translated in understanding development plans, policy procedures, and regulations.
She said she expects all human rights-related law issues to be resolved through the SNP.
