Jakarta (ANTARA) - House of Representatives (DPR) member Rudianto Lallo said that the newly effective Criminal Procedure Code (KUHAP) serves as a guide for law enforcers to avoid using the law to oppress or criminalize citizens.

As a drafter of the legislation, he expressed hope that disputes and controversies related to misuse of law will no longer occur with the new KUHAP. He emphasized that both the KUHAP and the criminal code (KUHP) represent a new direction for Indonesia’s legal system.

“This is a new direction for our law, which we hope can address the existing legal problems and challenges in our country,” Lallo said here on Friday.

He explained that the new KUHP, as substantive law, has transformed from a colonial legacy into Law No. 1 of 2023, while the new KUHAP, as procedural law, provides guidance for law enforcement.

“With this, we welcome a new legal direction where the character of KUHAP is no longer retributive or vengeful, but restorative, focusing on recovery,” he said.

Lallo added that the new KUHAP promotes equality between the state and citizens and strengthens the role of defense attorneys. He also urged law enforcers to actively socialize and implement the KUHP and KUHAP according to the stipulated regulations.

Coordinating Minister for Legal, Human Rights, Immigration, and Corrections Yusril Ihza Mahendra said the enforcement of the new KUHP and KUHAP marks the start of a new era in law enforcement in Indonesia.

He noted that the laws end more than a century of colonial-era criminal legislation. “This moment opens a new chapter for national law enforcement that is modern, humane, just, and rooted in Pancasila values and Indonesian culture,” Mahendra remarked on Friday.
