The ministry is currently drafting a revision to Ministry of Trade Regulation No. 31 of 2023 on electronic commerce to ensure a fairer online trading environment. A key provision under review includes service fee issues.
Director General of Domestic Trade at the Ministry of Trade, Iqbal Shoffan Shofwan, told the press in Jakarta on Thursday that the regulation revision is currently being finalized and is targeted for completion in the near future.
"Ultimately, the goal of this regulation is to improve transparency from platforms to sellers," he said.
Shofwan emphasized that fee structures within the marketplace ecosystem are part of business-to-business (B2B) arrangements, meaning the government does not directly intervene by capping rates.
Nevertheless, he stated that the government encourages any fee adjustments to be made based on mutual agreements between platforms and businesses—including micro, small, and medium enterprises (MSMEs)—to maintain fairness within the e-commerce ecosystem.
Meanwhile, the Ministry of MSMEs is drafting a ministerial regulation on the protection and competitiveness enhancement of MSMEs, which will also govern fee management in marketplaces.
MSMEs Minister Maman Abdurrahman said in Jakarta on Monday (May 18) that the regulation aims to prevent platforms from arbitrarily raising service fees, as the move could potentially disrupt the business continuity of micro and small enterprises.
He explained that in the regulation, marketplace platforms and sellers are required to sign long-term cooperation contracts with a minimum period of one year. This ensures that fee components are agreed upon from the start and cannot be changed unilaterally.
Furthermore, should a marketplace platform wish to adjust its fees, it must provide a notification at least three months in advance.
