"We (KPK) have not yet decided to apply the reverse burden of proof principle , but if necessary we will do it," KPK spokesperson Johan Budi said here Friday.
The tax graft cases involving Gayus Tambunan were now still being investigated by KPK, Johan said, adding that if the cases were handled by the police, the reverse burden of proof system might be necessary.
However, according to Johan, Indonesia had no special law on the reverse burden of proof system but it may be resorted to in dealing with graft cases.
Speaking at a fortnightly meeting to evaluate the performance of a tax mafia eradication task force on Tuesday (Feb 22), Vice President Boedione said the reverse burden of proof principle should be used in investigating the corruption and tax evasion cases of Gayus Tambunan.
"We will resort to the reverse burden of proof system as it is effective and regulated in the law," Boediono said, adding that it could be used as an instrument to eradicate corruption.
According to Boediono, the reverse burden of proof systen had two advantages.
Missing state funds could be restored without long-term processes and corruption could be prevented and eradicated effectively, he said.
