The draft law is a revision of the Law on KPK, which has been seen as a super body with two much authority.
KPK rejects proposal to revise the KPK law on a number of reasons, said acting chairman of the anti graft agency Taufiequrrachman Ruki here on Wednesday.
First, KPK leaders rejects limit to working term for KPK as said in the draft law.
The draft law call for the termination of KPK after 12 years, Ruki told reporters in a news conference here.
"The decision of the Peoples Consultative Assembly (MPR) rules no time limit for KPK to operate," he said.
Second, there is no need to abolish KPK authority in prosecution as prosecution is an inseparable part of handling a case, he said.
"For 12 years KPK has proved good cooperation in the process of investigation and prosecution with 100 percent of suspects convicted," he added
Third, KPK leaders also reject limit to cases to be handled by the agency as called for the draft law which said KPK should handle corruption cases only for ones involving state fund of more than Rp50 billion.
"It makes no sense as KPK is focused more on legal subject rather than on state losses... " Ruki said.
Fourth, KPK has improved accountability of its authority in tapping (conversations) therefore, there is no reason for restricting the authority as called for by the draft law, he said.
"Based on a decision of the Constitutional Court in 2003, KPKs tapping authority is not contrary to the law, therefore, it should be maintained. So far, tapping has contributed to KPKs success in carrying out its mission. Abolishing the tapping authority would weaken KPK in its fight against corruption," he said.
Fifth, KPK leaders also reject Order to Stop Investigation (SP3) by KPK.
"KPK remains without SP3 unless the suspect died. In language of the law unfit to stand trial," Ruki said.
The sixth, KPK rejects opposition to KPK naming own investigators. So far KPK investigators have been supplied by police and the prosecution office.
"KPK should be given the authority to recruit own staff and name investigators and general prosecutors to be installed by KPK leaders based on competence, not with the status as police and prosecutors," Ruki added.(*)
