Jakarta (ANTARA) - It is necessary to formulate an Appraiser Law to support and protect the duties and responsibilities of appraisers in Indonesia, the Directorate General of State Assets at the Finance Ministry has said.

"This was proposed in 2009 and in 2022, we will see developments regarding appraisers and appraisals; this is important, thus we encourage this profession to have a law," director general of state assets, Rionald Silaban, said at a media briefing on Friday.

An appraiser is someone who has the skill, ability, and experience to conduct appraisals to determine appropriate economic value. Their opinion on an item's value becomes the basis or reference for various transactions.

Currently, appraisals are carried out by public appraisers from the Public Appraisal Service Office, who offer the services to the public.

In addition, there are appraisers at the government level, such as tax assessors at the Directorate General of Taxes, appraisers involved in the management of state assets at the Directorate General of State Assets as well as other ministries and institutions, such as the Agrarian and Spatial Planning Ministry and regional governments.

Currently, Indonesia has 1,579 appraisers, comprising those from the Directorate General of State Assets, Directorate General of Taxes, and regional governments, and public appraisers from the Indonesian Appraisal Profession Society (Mappi).

Appraisers play a strategic role in optimal asset management by providing opinions on value that serve as a reference during asset buying and selling transactions.

Appraisers also support the presentation of the balance sheet at fair value so as to support good governance at government and private institutions and can optimize potential sources of funding through financing.

Appraisers also contribute to the optimization of idle assets and strategic assets so as to create maximum benefits and impact for the public. For example, through the provision of infrastructure with a mechanism of cooperation or lease between the government and the private sector.

The use of the fair value assigned by the appraiser also supports the optimization of state revenues from both the taxation sector and non-tax state revenues.

In the banking sector, their opinion of the value of a creditor's collateral assets can be put into consideration for granting a loan ceiling, so it can mitigate non-performing bank loans.

The duties and responsibilities of appraisers are in line with the first paragraph of Article 28G of the 1945 Constitution, which emphasizes that the state upholds everyone's rights to the protection of their property, as in the protection of self, family, honor, and dignity.

The third paragraph of Article 33 of the Constitution also stipulates that earth, water, and natural resources contained therein are under the control of the state and are to be used to ensure the utmost prosperity of the people.

Therefore, the state is obliged to ensure that all state instruments pursue justice and protection of everyone's property and conduct good management of resources.

Appraisers can play an impartial role in maintaining sustainable development while still upholding the rights of everyone to their property, thus the state has the responsibility for supporting their existence.

One aspect that is necessary for appraisers to support the appraisal process is the establishment of a property transaction data center.

"This is also (meant to provide) legal certainty on the results of value opinions by appraisers in order to obtain legality before the law," director of appraisals at the Directorate General of State Assets, Arik Haryono, said at the media briefing on Friday.

The law on appraisers will spark new hope as it would provide a legal basis for appraisers to do their job, he added.

In the Southeast Asian region, countries such as Malaysia, Singapore, and Vietnam, already have an Appraisal Law; therefore, the law is deemed important for Indonesia, and there is an urgent need to formulate it immediately.
