"Before we issued the Perppu, the government, especially the Ministry of Manpower, had carried out socialization and absorbed aspirations in various districts/cities," she said during the Child Protection Petition Signing event in Central Jakarta, Sunday.
She conveyed that the socialization which was carried out openly and had gone through a long process in various regions in Indonesia involved all related elements.
This includes inviting employers and trade unions to bring together the interests of the two parties, she added.
"Including the Indonesian Employers' Association (Apindo) and our friends from the labor union. We also visited universities and asked an independent institution to conduct a study of the Job Creation Law," the minister remarked.
From the results of this socialization, the ministry then made improvements to Law Number 11 of 2020 concerning Job Creation (UU Cipta Kerja) which was previously declared unconstitutional by the Constitutional Court (MK) in 2021.
"From the results of absorption of aspirations and socialization, the government then formulated the improvements to the Job Creation Law through Perppu Number 2 of 2022," she continued.
For this reason, Fauziyah said all parties must comply with the Ciptaker Perppu which will be submitted to the Indonesian House of Representatives (DPR) for approval to become law.
"This law is binding on all citizens, the Perppu will then be approved by the DPR, then the law will be binding on the entire nation," she noted.
The minister was also reluctant to comment much when asked about the request for judicial review submitted by a number of elements of society to the Constitutional Court (MK).
As with the constitutional mechanism, she stated if people disagree with the decision, they can indeed apply for a judicial review to the MK.
Previously, President Joko Widodo had stipulated and issued Government Regulation in Lieu of Law (Perppu) Number 2 of 2022 concerning Job Creation, as an urgent need to anticipate global conditions.
The consideration of establishing and issuing a Perppu was an urgent need, in which the government needed to accelerate anticipation of global conditions both related to the economy and geopolitics.
