Jakarta (ANTARA) - Chairperson of the National Commission on Human Rights (Komnas HAM), Anis Hidayah, emphasized that the bill on the revision of the Criminal Procedure Code (KUHAP) must be modern and uphold a human rights perspective.

“The bill on the revision of KUHAP must ensure the new law is modern and has the human rights perspective,” Hidayah stated during a discussion titled “KUHAP Revision and Human Rights Guarantees” here on Friday.

The Komnas HAM chairman stressed that the revision should be used to align Indonesia’s criminal procedural law with human rights principles, since, according to Komnas HAM, the current KUHAP does not yet provide for them.

Hidayah referenced reports received by Komnas HAM indicating frequent allegations of torture during investigation and interrogation processes, pointing to unprofessional conduct by law enforcement officers.

“There are numerous cases concerning justice fulfillment for the public, particularly related to the lack of professionalism among law enforcement. This is why we are pushing for a paradigm shift in the KUHAP revision bill that prioritizes the protection and respect of human rights,” she stated.

Komnas HAM has identified 11 key points or clusters of criminal justice regulation that must be considered. The commission also submitted 10 points of recommendation to the Ministry of Law.

From the recommendations proposed, Komnas HAM has not yet seen them fully accommodated in the KUHAP bill currently being discussed in the House of Representatives (DPR) Commission III.

Furthermore, Hidayah stated that Komnas HAM continues to communicate with Commission III to schedule a face-to-face meeting to discuss the contents of the KUHAP Bill that are not yet aligned with human rights. “We have submitted a request for a meeting,” she stated.
