The Institute for Motivational Living, Inc. (IML) a US-based publishing and technology company, has announced that it has won a copyright infringement lawsuit against defendants Infigy Group, and a consultant and senior trainer to Infigy, Mr. Didik Mulato. Infigy Group (http://www.infigygroup.com) is a Product Marketing Group of Prudential Insurance according to their website.
The ruling by the Council of Judges of Commercial Court of Surabaya, Indonesia had found the defendants in violation of IML's copyrights and declared IML to be the rightful copyright holder for the DISC Personality System Profile. The lawsuit focused upon the defendant's copying, and distributing of IML copyrighted materials without prior consent from IML. The defendants had offered IML's materials free of charge as part of a strategy to have people use DISC to gain an understanding of personality styles in the defendant's business process. IML successfully argued they suffered loss of revenue since defendants were giving away IML's intellectual property intended for commerce. IML, the author and publisher, had registered materials with the United States Copyright Office preceding defendant's use. Indonesian law also includes criminal prosecution for copyright infringement and further investigation of the violation is ongoing.
