Jakarta (ANTARA) - Two members of the North Sumatra Regional Legislative Council (DPRD) for the 2009-2014 period were granted six years in prison and two others four years in prison because it was proved they had received bribes from former North Sumatra Governor Gatot Pujo Nugroho.

The four members were Arifin Nainggolan (Democratic faction), Mustofawaiyah (Democratic faction), Sopar Siburian (Democratic Party faction) and Analystman Zalukhu (PDI-P faction).

"It was proved that the defendants had legally and convincingly committed criminal acts of corruption together, imposing imprisonment on Defendant 1 Arifin Nainggolan and Defendant 2 Mustofawaiyah of six years plus a fine of Rp. 700 million, or six months imprisonment," said Nanang Suryadi, public prosecutor of the Corruption Eradication Commission (KPK) at the Jakarta Corruption Court (Tipikor) on Wednesday.

Arifin had to pay a compensation of Rp.530 million, which if not paid in a maximum of one month after the verdict was legally enforceable, he would be given additional two years imprisonment.

Meanwhile, Mustofawaiyah was required to pay a compensation of Rp.480 million, which if not paid a maximum of one month after the verdict was legally enforceable, he would be jailed for additional two years.

"It was proved legally and convincingly that the defendants had committed criminal acts of corruption together. The imprisonment imposed on Defendant 3 Sopar Siburian and Defendant 4, Analystman Zalukhu, was four years plus a fine of Rp300 million, or three months imprisonment," prosecutor Nanang added.

Sopar Siburian was required to pay a compensation of Rp.270.5 million, which if not paid in a maximum of one month after the verdict was legally enforceable, he would be granted additional six months in prison.

Meanwhile, Analystman Zalukhu was required to pay a compensation of Rp.400 million, which if not paid in a maximum of one month after the verdict was legally enforceable, he would be granted additional six months.

The KPK public prosecutor also demanded the revocation of political rights.

"It was demanded that the panel of judges drop the right to be elected in public office for Defendant 1 and Defendant 2 for five years after the defendant completed his basic sentence, and Defendant 3 and Defendant 4 for three years after the defendant completed his basic sentence," said Prosecutor Lie.

The prosecutor considered that Arifin Nainggolan and Mustofawaiyah were manipulative and had not returned all the bribes received, while Sopar Siburian and Analystman Zalukhu were forthright and returned a portion of the money received.

The demand was based on the second indictment of article 12 letter b of Law No. 31 of 1999 as amended by Law No. 20 of 2001 concerning the Eradication of Corruption Crime in conjunction with Article 55 paragraph (1) of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code.

In the claim, Defendant I Arifin Nainggolan mentioned Rp.540 million, Defendant II Mustofawaiyah Rp.480 million, Defendant III Sopar Siburian Rp.480 million and Defendant IV Analystman Zalukhu Rp.752 million from Gatot Pujo Nugroho as the then governor of North Sumatra Province.

The local legislators had been bribed to ensure approval of the North Sumatra government's reports on spending of the province's budget. EDITED BY INE
