Denpasar, Bali (ANTARA) - The Denpasar state court has sentenced Algerian defendant Mohammed Kherici (34) to nine months in jail for stealing two cameras from a room in a hostel, which he was sharing with a guest.

"Judging, and declaring that the defendant was proven legally and convincingly guilty of a criminal act of theft as regulated in Article 362 of the Criminal Code," said the panel of judges chaired by, Ida Ayu Nyoman Adnya Dewi, here Tuesday.

The defendant was sentenced to nine months in jail, reduced by a number of days when he was in detention, and the defendant was remanded to detention.

The sentence received by the defendant was lighter than what was demanded by the public prosecutor, Ni Putu Trisna Dewi, which was for a year in prison.

The incriminating factors were the actions of the defendant of disturbing the community and causing harm to the victim’s witness, while mitigating factors, among others, were that the defendant confessed and regretted his actions, promised not to repeat it and offered his apologies. The victim forgave him.

According to the case registered, the defendant was in a hostel room on Jalan Poppies I Gang Sorga, Kuta, Badung with six other people.

The defendant left the room to buy cigarettes and when he returned to the room it was vacant. He noticed a camera in an open bag belonging to a guest he did not know.

The defendant then took the camera and left the room.

Not long afterwards, the defendant felt sorry for his actions and returned to the hostel.

However, on returning, he noticed that people had gathered outside the hostel to apprehend him because the foreign national who was a private worker had realized his camera was missing and raised an alarm.

The defendant was discovered with a 6D black camera along with a bag and lens cap, two batteries and white cables as well as a camera charger.

His actions also included taking cash totaling Rp3.2 million and a 550D camera along with lenses, bags and other camera accessories. The total loss was estimated at Rp61.7 million.
