Komnas HAM Chairperson Atnike Nova Sigiro stated that since the Second Optional Protocol to the International Covenant on Civil and Political Rights (ICCPR) was adopted in 1991, abolishing the death penalty has been a mainstream international norm.
"The Indonesian government needs to continue to be consistent in drafting a Draft Government Regulation in accordance with existing developments in the new National Criminal Code," she remarked here on Thursday.
Sigiro affirmed that provisions on the death penalty are stipulated in Article 6, paragraph 1 of the ICCPR which states that every human being has the inherent right to life and that no one shall be arbitrarily deprived of his life.
Meanwhile, in the new National Criminal Code, the death penalty is regulated as an alternative punishment, and there are also regulations regarding postponement of the death penalty execution.
The Indonesian government has also prepared a Draft Government Regulation regarding Procedures for Changing Life Sentences and the Death Penalty.
Komnas HAM assessed that the government should consider a moratorium or suspension of the implementation of the death penalty and elimination of the implementation of the death penalty for new cases.
"To support the abolition of the death penalty in Indonesia, the ratification of the Second Optional Protocol is an important step to be carried out by the government," she emphasized.
Indonesia is one of the countries that has ratified the ICCPR with the issuance of Law Number 12 of 2005 on the Ratification of the International Covenant on Civil and Political Rights.
