He emphasized that as long as data transfers comply with Indonesian regulations, they will not run counter to any human rights principles.
“The clause clearly states that the data transfer must comply with Indonesian law — in this case, the Personal Data Protection Law,” he pointed out in a statement received in Jakarta on Saturday.
The minister assured the public that the Indonesian government will guarantee that transfers of data are carried out in a careful, responsible, and secure manner.
He reiterated that even if personal data is involved, the two countries will only process such transfers within a legitimate framework.
“If that is the case—I repeat—the transfer does not violate or contradict any principles of human rights,” Pigai stressed.

Through a fact sheet and joint statement on its website on July 22, 2025, the White House announced that Indonesia and the United States have agreed on the framework for an Agreement on Reciprocal Trade during bilateral negotiations on President Donald Trump’s tariff policy.
A key provision of the agreement is Indonesia’s commitment to eliminating barriers to bilateral digital trade, including by allowing and supporting the transfer of data to the US.
“Indonesia will provide certainty regarding the ability to move personal data out of its territory to the United States through recognition of the United States as a country or jurisdiction that provides adequate data protection under Indonesia’s law,” the fact sheet states.
On Friday, State Secretary Minister Prasetyo Hadi assured citizens that the Indonesian government has not and will not hand over their personal data to the US under the trade deal.
“The interpretation is incorrect. It does not mean we will hand over data, especially the personal data of Indonesian citizens, to the US,” he said at the Presidential Palace in Jakarta.
The minister explained that some US-based platforms require users to provide personal data when using their services, adding that the US government is seeking assurances that such data will be protected from misuse.
He also emphasized that the Indonesian government will fully adhere to the Personal Data Protection Law.
