Jakarta (ANTARA) - Deputy Minister of Law Edward Omar Sharif Hiariej stated that 17 issues flagged by the Corruption Eradication Commission (KPK) in the Draft Criminal Procedure Code (RKUHAP) have been discussed with the anti-graft agency.

The issues relate to inconsistencies between the RKUHAP and Law Number 19 of 2019 on KPK.

“Yes, they have been discussed, and there have been further talks with the KPK,” Hiariej remarked when met after a public discussion on The World Day Against Trafficking in Persons here on Thursday.

Nevertheless, he clarified that these issues fall under the jurisdiction of Commission III of the House of Representatives (DPR), which is still discussing the RKUHAP.

Earlier, KPK spokesperson Budi Prasetyo stated at the KPK Building here on Wednesday (July 16) that among the 17 identified issues are concerns over the removal of KPK's lex specialis status, or the special authority, in the RKUHAP, as well as the limitation of KPK case handling to procedures outlined in the Criminal Procedure Code.

Moreover, the RKUHAP does not recognize KPK investigators, specifying that investigators would only be from the National Police (Polri).

Additional concerns involve the RKUHAP’s narrower definition of investigation as merely "finding and identifying criminal acts," while under the KPK Law, investigations are defined as "the process of finding at least two pieces of evidence."

Meanwhile, Deputy Speaker of DPR Sufmi Dasco Ahmad stated that Commission III has requested permission to hold meetings on the draft revision during the recess period to gather public opinion.

He emphasized that the DPR will prioritize public participation in the RKUHAP discussion, as well as in other law revisions.
