"Then CCTV (surveillance cameras) for examinations, bodycams, perhaps this could be considered," Minister of Law Supratman Andi Agtas said in a press conference on Monday (January 5).
According to him, this policy will be discussed with the drafting team for the government regulation (RPP).
"We also try to incorporate it into the RPP because it is based on information technology. We will discuss it with Team 12 in the context of preparing and refining the upcoming RPP," the minister continued.
The derivative of the KUHAP Law currently being drafted by the government is the Draft Presidential Regulation on an Information Technology-Based Criminal Justice System.
Previously, President Prabowo Subianto signed the Criminal Procedure Code (KUHAP), and it was promulgated by Prasetyo Hadi as Minister of State Secretary on December 17, 2025.
Based on Article 369 of the KUHAP, this law has been in effect since January 2, 2026.
Meanwhile, Article 30 of the KUHAP stipulates that the examination of a person suspected of committing a crime must be recorded using surveillance cameras during the examination.
This recording can be used for the purposes of investigation, prosecution, and defense of the suspect or defendant. However, further regulations must be stipulated in a Government Regulation.
Furthermore, Article 23 paragraph (7) and Article 68 of the KUHAP stipulate that investigators and public prosecutors who violate statutory provisions or the code of ethics may be subject to administrative, ethical, or criminal sanctions.
Deputy Minister of Law Edward Omar Sharif Hiariej also emphasized that the regulations in Law Number 20 of 2025 concerning the Criminal Procedure Code (KUHAP) regarding surveillance cameras aim to prevent intimidation.
"The surveillance cameras are to ensure that investigators do not torture or intimidate suspects, victims, or witnesses," he noted on Monday.
According to him, several articles in the KUHAP regulate that investigators and public prosecutors must not act arbitrarily, demean human dignity, or act unprofessionally.
