The panel of judges, led by Diah Siti Basariah, with Duta Baskara, Sunarso, Sigit Herman Binaji and Joko Subagyo as members also agreed to require Nur Alam to pay Rp2.7 billion in replacement fund and revoke his political rights for five years after serving his jail term.
"If the defendant cannot afford to pay the replacement fund one month after the court`s verdict has fixed legal force, the public prosecutor will confiscate his wealth to cover the replacement fund. And if the defendant has not adequate wealth, then he will be sentenced to another five years in jail," judge Diah said.
Nur Alam was found guilty of issuing dubious mining licenses which have inflicted Rp1.59 trillion in state losses and receiving a gratification of Rp40.268 billion.
The sentence is six years lighter than that sought by the public prosecutors who have demanded that the defendant be sentenced to 18 years in jail and fined Rp1 billion or face another 1 year`s imprisonment.
