The National Police's decision to proceed with dismissal or disrespectful dismissal (PTDH) was in line with Law Number 2 of 2002 concerning National Police, Lemkapi Executive Director Dr Edi Hasibuan remarked in Jakarta, Monday.
"We understand this decision has been taken to uphold the good name and honor of the National Police in the eyes of the public," he remarked.
Hasibuan pointed out that TT had also violated Article 11 of Regulation of the Chief of the National Police Number 14 of 2011 on the Code of Ethics for the National Police Professional. Article 11 stipulates that every National Police member should obey and respect the norms of decency, religious norms, values of local wisdom, and legal rules.
The former member of the National Police Commission (Kompolnas) believes that TT's actions had marred and violated religious norms and civility.
"However, our main area of concern regarding TT is him not being disciplined in his actions. We are optimistic that this will serve as an eye-opener for all members of the National Police to abide by the rules, remain disciplined, and uphold the honor and image of the Indonesian National Police," he stated.
He stressed that TT's conduct had tarnished the image of the National Police, particularly at a time when it had worked consistently to earn the community's trust through a professional, modern, and trusted program launched by National Police Chief General Tito Karnavian.
"We opine that the issue of sexual deviance is increasingly influencing the National Police's decision to not waver in giving PTDH to TT, as he has dishonored the National Police," this legal expert stated.
Earlier, TT serving in the Central Java Regional Police was fired over deviant sexual orientation. He was dismissed following a code of ethics hearing on October 18, 2018.
TT then challenged his dismissal by filing a lawsuit with the Administrative Court (PTUN) in Semarang.
Edi Hasibuan affirmed that the lawsuit filed with PTUN was the police's right to be respected.
"We see that it is a normal thing and must be respected, as it is his right. We will wait for the judge's decision," he added.
