Sleman, Yogyakarta (ANTARA News) - A court in Sleman, Yogyakarta, rejected death row convict Mary Jane Fiesta Velosos judicial review petition on Monday.

"The decision to reject the review plea was taken in line with the law, which states that if request for a judicial review of a case is rejected once, another review petition will not be entertained," court spokesman Marliyus said.

He noted that the Sleman district court will be immediately informing Mary Janes lawyer who submitted the review plea only a few hours ago.

"We are submitting the judicial review petition as a new piece of evidence has emerged showing that Mary Jane was not the middle person who was involved in a narcotic transaction for which she has been convicted," Mary Janes lawyer Agus Salim said while submitting the request for a judicial review at the Sleman district court here on Monday.

He pointed out that the request is based on the Constitutional Courts ruling that allows the submission of a judicial review request more than once in a criminal case to ensure that truth and justice prevail.

"The new piece of evidence we have submitted is in the form of an authentic document," he added.

Mary Jane is one of the ten death row convicts who are facing execution after their request for clemency had been rejected by President Joko Widodo (Jokowi).

She was sentenced to death by the Sleman district court in 2010 after customs officers at Yogyakartas Adisutjipto airport caught her upon arrival from Kuala Lumpur with 2.6 kilograms of heroin worth Rp5.5 billion.

Mary Jane is currently placed in an isolation cell in a jail on Nusakambangan Island, Central Java, where convicts awaiting execution are kept.

With regard to French death row convict Serge Areski Atlaoui, Attorney General HM Prasetyo said on Monday that his execution will be carried out separately after an administrative court settles the legal process of his complaint on the rejection of his clemency plea.

"Yes. (He will be executed separately) because it has to be done based on the due process of the law," he added.

He noted that clemency is the presidents prerogative.

The attorney general, meanwhile, reminded his lawyer to be guided by patriotism while dealing with the case and not to readily defend the interest of other countries.

"All the requests of convicts may not always be met if they run against the law" he stressed.

Serge Areski Atlaoui has sought a legal way out through the administrative court to avoid execution.

The Attorney Generals Office spokesman, Tony Tribagus Spontana, confirmed the postponement of Atlaouis execution due to the legal process.

He, however, denied that the postponement was because of pressure from the French Government.

"It is not because of pressure from the French president," he said.

Just days before his execution, Sergei has challenged the presidents decision refusing to pardon him.

"He registered his complaint in the last minute, before the deadline at 4 P.M. on Thursday (April 23)," he pointed out.

He emphasized that the AGO respects the ongoing legal process and hence decided not to include Sergei in the group to be executed soon.

If the administrative court rejects his complaint, he will be executed immediately, he stressed.
