Jakarta (ANTARA) - Communication and Informatics Minister Johnny G. Plate stated here on Thursday that personal data governance will be regulated in a government regulation (PP) according to the mandate of the law.

The minister conveyed the statement following the agreement of the Communication and Informatics Ministry along with Commission I of the Indonesian House of Representatives (DPR RI) to discuss the Personal Data Protection (PDP) Bill at the plenary session of the House to ratify it into law.

The minister remarked that the governance on personal data will be conducted by an institution that will be accountable to the president.

Thus, the president will determine whether data governance will be conducted by a ministry's institution or a new institution that will be established later, he stated.

“Later, it will be up to the president to decide. It is entirely the president's decision," Plate noted.

Furthermore, he said that the legal basis for the operation of the institution will be the PDP Law that will be ratified soon.

“The PDP Law will become the legal basis that mandates (the data governance) to be regulated in the PP. Thus, later, we will establish a PP to handle (the protection of) personal data," he noted.

In addition to regulating institutional governance, he stated that the PDP Law also regulates sanctions for unlawful acts against personal data protection.

“The punishments are much more severe than the current ones – both the sanctions for the criminal acts as well as the fines for mistakes (on failing to protect the personal data) made by individuals, corporations, public institutions, or international institutions," the minister remarked.

He also reminded the people to be careful in using their personal data.

"Any business that illegally tries to take, control, use, and exploit (personal data), including exploiting it economically, will be subjected to strict and severe sanctions as regulated in the PDP Law, which hopefully will be ratified by the DPR RI soon,” he added.
