Jakarta (ANTARA) - Indonesia's National Human Rights Commission (Komnas HAM) has determined that second police inspector adjutant (Aipda) RZ, who fatally shot public vocational school (SMKN) 4 Semarang student GRO, violated human rights.

"Mr. RZ's actions fulfill the elements of a human rights violation as defined in Article 1, paragraph (3) of Law Number 39 of 1999 concerning Human Rights," Uli Parulian Sihombing, coordinator of the monitoring sub-commission, said in a statement released in Jakarta on Thursday.

He informed that RZ's actions violated the right to life, as stipulated in Article 9, paragraph (1) of the Human Rights Law. The shooting, which resulted in GRO's death, deprived the victim of this fundamental right, the commission said.

Additionally, Komnas HAM classified the incident as an extrajudicial killing. The commission ruled that the shooting, which also injured two others, could not be justified as self-defense. RZ was off-duty and not facing any immediate threat from the motorcycle riders.

"Mr. RZ was not carrying out a lawful order to shoot the three victims," Sihombing stated.

Furthermore, RZ was found to have violated the right to be free from cruel, inhumane, and degrading treatment, as outlined in Article 33, paragraph (1) of the Human Rights Law.

The shooting was also deemed to have violated the provisions of Article 3 of the Chief of Police Regulation Number 1 of 2009 concerning the Use of Force in Police Actions, which outlines the principles of legality, necessity, proportionality, general obligations, prevention, and reasonableness.

Komnas HAM said that RZ also violated the right to child protection, as stipulated in Article 52, paragraph (1) of the Human Rights Law. All three victims, including GRO (17), were minors and should have been protected from harm.

"As a state official and a police officer, Mr. RZ should not have shot the children. The police are prohibited from using firearms against children," Sihombing explained.

The Komnas HAM's findings are based on monitoring conducted in Semarang from November 28 to 30, 2024.

The commission gathered information from several sources, including the Central Java Regional Police, Semarang Police, Bidpropam of the Central Java Regional Police, the victim's family and witnesses, medical and digital forensic evidence, and a site visit.

The shooting occurred early on November 24 in the Simongan area of West Semarang. GRO, the victim, was buried in Sragen the same day.

While RZ has been detained, he has not yet been named a suspect. The Central Java Regional Police has confirmed that an ethics hearing will be held for RZ as soon as possible.

Earlier, Semarang City Police Chief (Polrestabes) Commissioner of Police Irwan Anwar confirmed that his officer opened fire on a student with the initials G who was suspected of being involved in a brawl and was a member of a youth motorcycle gang.
