Even though the circular does not have legal power, if industry players utilizing or developing AI are found violating it, they can still be subject to sanctions or penalties in accordance with the applicable regulations.
Jakarta (ANTARA) - The Ministry of Communication and Informatics (Kominfo) has committed to preparing a special regulation on artificial intelligence (AI) after issuing Circular Letter Number 9 of 2023 on Artificial Intelligence Ethics.

"In the near future, we will also start to prepare a legally binding AI regulation. Through this regulation, we hope to provide legal certainty in the use and development of AI," Communication and Informatics Minister Budi Arie Setiadi said here on Friday.

According to him, the issuance of the circular marked the opening stage for further preparation of a legally binding regulation.

He said that while the special AI regulation is being prepared, the circular on AI ethics could serve as a useful guideline so that the use and development of AI can move in a positive direction in Indonesia.

Even though the circular does not have legal power, if industry players utilizing or developing AI are found violating it, they can still be subject to sanctions or penalties in accordance with the applicable regulations.

"This circular is not legally binding but rather serves as a guideline. Therefore, the development and use of AI must comply with applicable laws and regulations, such as the information and electronic transaction law and the personal data protection law," he explained.

He further said that later, the ministry will coordinate with the House of Representatives (DPR) regarding the special regulation on AI.

With the presence of studies that have been prepared, it is hoped that the AI regulation can be discussed faster.

"The new circular serves as a bridge for us toward a more comprehensive law that regulates AI, while monitoring the development in the society," he said.
