Jakarta (ANTARA) - The Indonesian Parliament should immediately start to revise Law No. 11 of 2020 on Job Creation after the Constitutional Court (MK) has ruled it is conditionally unconstitutional, according to a House member.

"The decision of the Constitutional Court regarding the Job Creation Law is final and binding. Hence, the government and the House of Representatives (DPR RI) must immediately initiate the revision of the law," Chairman of the PAN Faction at the House of Representatives Saleh P. Daulay remarked here on Friday.

Daulay noted that the Parliament should amend the law, as it is the best option after MK's decision.

He believes the law revision must be conducted at the earliest since the deadline given by MK is tight as well as the fact that the scope and number of articles in the Job Creation Law are quite extensive.

Daulay explained that all succeeding decisions should abide by MK's ruling, such as not issuing any derivative rules and policies based on the Job Creation Law.

"I view the verdict positively. It is clear that MK is independent. Although (the law) was not declared contrary to the 1945 Constitution, with a ruling like this, the function of the Constitutional Court, as a guardian of the constitution, is accentuated," he expounded.

According to Daulay, MK's decision offers a learning for the government and the House, as the experience of creating the Job Creation Law or Omnibus Law is still new in Indonesia.

Hence, he believes it is rational that the MK gave recommendations of rectifications and improvements. Hence, in future, if there is a discussion of another Omnibus Law Bill or others, all MK rulings can be taken into account.

"For instance, Law 12 of 2011 on the Creation of Laws and Regulations states that in making the law, the public should be involved and participate in addition to being careful about the words' arrangement and typing as well as other records," he pointed out.

Moreover, he is optimistic that MK's ruling would not lead to any accusations or blaming as what is necessary is how the government and the House can forge sound synergies to revise the law through open public involvement and participation.
