"We impose a collective verbal reprimand on the judges," Chairman of MKMK Jimly Asshiddiqie stated while reading out the verdict at the Constitutional Court Building here on Tuesday.
The parties that reported the misconduct of the judges were the Indonesian Legal Aid and Human Rights Association (PBHI), Advocacy Team for Caring Indonesian Law, the Constitutional Guardian Advocate, Madani Youth Association, and an advocate named Alamsyah Hanafiah.
"The reported judges are proven to have violated the code of ethics and conduct of constitutional judges as stated in Sapta Karsa Hutama, (especially the) Principle of Propriety," Asshiddiqie remarked.
He explained that the Honorary Council concluded that the judges were proven unable to keep confidential information of the judges' closed consultative meetings.
He remarked that the MKMK, in its verdict, concluded that the reported judges allowed the violations to occur without the sincerity to remind one another of their faults, including of their leaders, due to the pushover working culture.
"Thus, equality between judges was overlooked, and ethical violations could occur. Thus, the reported judges were proven to have violated Sapta Karsa Hutama," he added.
MKMK recommended that constitutional judges should not allow the habit of influencing each other in examining, adjudicating, and deciding a case.
Constitutional judges must maintain an intellectual environment brimming with ideas and conducive to truth-seeking, Asshiddiqie emphasized.
Constitutional justice must lead a life based on a clear conscience and sincerity for the benefit of the nation and state, he stressed.
"Constitutional judges, either individually and together, must have a legal and moral responsibility to keep confidential information discussed in judges' consultative meetings from leaking out," he stated.
